The College receives and investigates complaints against its members related to professional misconduct, incompetence or incapacity. The College strives to ensure fair and impartial treatment for its members while protecting the public interest. Complaints, Investigations and Hearings As members of a profession, teachers are always on duty. Just as doctors, lawyers, nurses, engineers and other professionals are bound by certain standards of conduct, so too are teachers. This notion needs to be viewed through the lens of reasonable expectation of conduct. One of the privileges associated with professional self-regulation is that the public has entrusted the profession to determine what a reasonable expectation of conduct looks like through the decisions and reasons of a panel of peers. Complaints to the College must relate to alleged professional misconduct, incompetence or incapacity. The College does not investigate complaints that are outside its jurisdiction or that are frivolous, vexatious or an abuse of process. When someone calls or writes the College to express a concern about a member, College staff assesses the nature of the complaint and, when appropriate, may discuss with the caller or the writer other ways to resolve the dispute, such as talking with the teacher, principal or school board officials. Formal complaints, which must be in writing, may be made by a member of the public, a member of the College, the Registrar of the College or the Minister of Education.

Despite receiving media attention in and , UBC policy concerning faculty-student relationships remains unchanged and, for the most part, unspoken of. If a student and professor had a relationship for outside gain, it would be mediated using the Conflict of Interest policy. Mac Lean says student-teacher relations should be given more attention by UBC — not necessarily because he believes that a complete ban should be introduced, but because it deserves a conversation.

The answer to an ethics question sometimes becomes obvious when it is apparent that every argument on one side is either a logical fallacy, an unethical rationalization, or the application of an invalid ethics principle. Such is the case here, and thus I somewhat question the motives of the author of the post, Kelly Anders. Wishful thinking, perhaps? This policy applies to all University employees (including faculty), student exists prior to the effective date of this policy to the University offices specified above as by OIE in collaboration with the Office of the Vice President for Legal Affairs.
This policy covers all UW System employees, students, and affiliated individuals. The purpose of this policy is to ensure that the employment and academic environment is free from real or perceived conflicts of interest when UW employees, students, and affiliated individuals, in positions of unequal power, are involved in consensual romantic or sexual relationships. Even where negative consequences to the participants do not result, such relationships create an environment charged with potential or perceived conflicts of interest and possible use of academic or supervisory leverage to maintain or promote the relationship.
Romantic or sexual relationships that the parties may view as consensual may still raise questions of favoritism, as well as of an exploitative abuse of trust and power. The following two types of consensual relationships are addressed in this policy: 1 employee with a student; and 2 employee with another employee. It is a violation of this policy for an instructor to commence a consensual relationship with a student currently under their instruction, and may result in disciplinary action against that employee.
If an instructor or other employee fails to meet the requirements for disclosing the relationship with a student or another employee, or fails to cooperate in the actions described above, such a failure constitutes a violation of this policy and may result in disciplinary action taken against that employee. To report potential violations of this policy, individuals should contact either the Director of Human Resources or the Title IX Coordinator. Retaliation against persons who report concerns about potential violations of this policy is prohibited.

A number of colleges and universities banned faculty-undergraduate dating or otherwise shored up their consensual relationship policies after the Education Department published a reminder letter about sexual harassment liability, in Other institutions had adopted such policies earlier. But what about unwanted attention or a perceived inability to say no? An increasing number of companies and schools are instituting no-dating policies for these reasons. Should law schools follow suit?

In the age of the MeToo movement and increased awareness around misuse of power and sexual abuse across many institutions, the University has approved the creation of a committee seeking to review and revise its current policies about student-faculty relationships.

A few weeks ago, Brock University allowed Professor David Schimmelpenninck to return to teaching after he had been absent for three years as a result of a discipline in a sexual harassment case involving a student. Ultimately, the course was cancelled before the first lecture ever took place, but the professor should never have been allowed to return, and this is not the first time a Canadian university has mishandled a sexual harassment claim.
In recent years, a toxic culture of grooming, harassment, and abuse in academia has been unearthed. A new report released last week from Silence is Violence U of T contains many troubling stories of professors sexually harassing and assaulting students. This report should serve as the catalyst for U of T to review its policies on sexual relationships between students and professors.
Currently, most Canadian universities do not have an explicit ban on these relationships. At U of T, professors may engage in sexual and romantic relationships with students, but are required to report any relationships of this nature to the chair of their department. The department chair is then responsible for relieving the professor of any professional duties relating to the student or appointing a third party to oversee these decisions.
While these guidelines are important for academic integrity, they do not go far enough to protect students or disrupt cultures of grooming and abuse in academia. American schools like Yale University and Harvard University have already banned romantic and sexual relationships between students and professors for this reason, and U of T should follow their lead.
